ENGLISH
On 29 July 2026, Vietnam’s Ministry of Health issued Circular No. 32/2026/TT-BYT on the registration of drugs and medicinal ingredients. The Circular took effect on 1 October 2026 and replaces Circular No. 12/2025/TT-BYT.
Scope
The Circular applies to chemical drugs, vaccines, biologicals, herbal-based drugs and active pharmaceutical ingredients for human use. Traditional medicines and medicinal herbs are regulated separately.
Key changes for importers and marketing authorization holders
- Dossiers follow the ACTD or ICH-CTD format and may be prepared in Vietnamese or English; the patient information leaflet must be in Vietnamese.
- For new drugs and certain other cases, the Certificate of Pharmaceutical Product (CPP) may be deferred at initial submission with a written justification, but must be provided no later than the second round of dossier supplementation.
- Consular legalization of foreign legal documents can be waived when the Drug Administration of Vietnam (DAV) is able to verify them electronically. Electronically notarized copies are also accepted.
- If a product uses an ingredient that already holds a marketing authorization in Vietnam with matching details, GMP documents for the ingredient manufacturer are no longer required – only two certificates of analysis.
- New drugs supported by original clinical data receive five years of data exclusivity from the first marketing authorization.
- After a refusal, applicants have one month to request reconsideration; if accepted, approval can be granted without submitting a new dossier.
Validity and post-approval obligations
- Registration certificates are generally valid for 5 years. New drugs, vaccines and biologicals that require continued monitoring receive 3-year certificates.
- Minor variations subject to notification (MiV-N) can take effect as soon as they are received by the DAV.
- Product recalls or market withdrawals must be reported to the DAV within 15 days.
What this means for our partners
For foreign manufacturers bringing products to Vietnam, the new rules reduce paperwork for legal documents and give more flexibility on the CPP. At the same time, dossiers need to be prepared carefully against the new requirements to avoid repeated supplementation rounds. LAMDACO is ready to support partners in reviewing their registration dossiers under Circular 32/2026/TT-BYT.
